These Terms and Conditions ("Terms") govern the purchase of products from Sundog Corporation OÜ through our online store (the "Store").

2. Products

The Store offers custom print-on-demand products (e.g., apparel, accessories, and other merchandise) made to the customer's specifications. Products are personalised based on designs, text, images, or other inputs provided or selected by the customer during the ordering process.

 

3. Ordering and Contract Formation

  • By placing an order, you submit an offer to purchase the selected products under these Terms.
  • The contract is formed when we (or our fulfillment partner) confirm acceptance of your order (e.g., via email or order status update in your account).
  • We reserve the right to refuse or cancel orders (e.g., due to pricing errors, unavailability, or suspected fraud).

 

4. Pricing and Payment

  • All prices are displayed in $USD and include applicable taxes where required.
  • Additional costs (e.g., shipping, payment processing fees) are shown clearly before checkout.
  • Payment is processed securely through our integrated providers. Title and risk pass upon delivery.

 

5. Delivery and Fulfillment

  • Products are fulfilled by third-party print-on-demand partners (e.g., Appliq or others).
  • Estimated production and shipping times are provided on product pages and during checkout; actual times may vary.
  • We are not liable for delays caused by carriers, customs, or force majeure events.
  • Risk of loss or damage passes to you upon delivery (or handover to the carrier).

 

6. Right of Withdrawal

Pursuant to § 56¹ clause 3 of the Estonian Law of Obligations Act (and Article 16(c) of Directive 2011/83/EU on consumer rights), the consumer does not have the right of withdrawal for contracts concerning the supply of goods made to the consumer’s specifications or clearly personalised.

All products sold in this Store are custom/personalised based on your chosen designs, text, images, or other specifications. Therefore, the standard 14-day right of withdrawal does not apply.

This exclusion is clearly communicated before purchase (on product pages, cart, and checkout). If this information had not been provided, the right would apply—but we ensure full pre-contractual disclosure.

7. Returns, Refunds, and Complaints

  • No returns are accepted for change of mind, sizing preferences, personal taste, or buyer's remorse due to the personalised nature of the goods.
  • Defects or non-conformity: Products are covered by the statutory 2-year legal guarantee under §§ 218–227 of the Law of Obligations Act. If the product has a manufacturing defect (e.g., printing error not matching the preview, incorrect item sent due to our error, or damage during transit attributable to us), contact us within a reasonable time (ideally within 2 months of discovering the issue) with photos or proof.
    • We will assess and, where confirmed, offer repair, replacement, price reduction, or full refund (including original shipping costs).
    • Return shipping: We cover costs for confirmed defects; otherwise, you may bear reasonable inspection/return costs.
  • Complaints: Email us first at [your email]. If unresolved, escalate to the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon) or the Consumer Protection and Technical Regulatory Authority (TTJA). For EU-wide disputes, use the Online Dispute Resolution platform: https://ec.europa.eu/odr.

 

8. Liability

  • We are liable only for direct damages caused by our intentional or grossly negligent acts.
  • We are not liable for indirect/consequential losses, or issues arising from customer-provided designs (e.g., copyright infringement).
  • Maximum liability is limited to the order value.

 

9. Intellectual Property

By uploading designs, you warrant you own or have rights to use them. You grant us a limited license to produce and fulfill the order. We do not claim ownership of your designs.

 

10. Applicable Law and Jurisdiction

These Terms are governed by the laws of the Republic of Estonia (with mandatory EU consumer protections). Disputes are subject to the exclusive jurisdiction of Estonian courts.

 

11. Changes to Terms

We may update these Terms. Continued use of the Store after changes constitutes acceptance. Significant changes will be notified where required.
